Investment Monitoring Services

One of the difficulties identified by institutional investors in becoming involved as a Lead Plaintiff is arriving at a decision as to whether or not to advance itself as a Lead Plaintiff during the 60 day period prescribed by the PSLRA for making the decision after the first securities fraud class action complaint has been filed against a company in its portfolio. The Investment Monitoring Services provided by Johnson & Perkinson provides an institutional investor with both a head start in assembling the requisite information for making the decision, as well as tailored expert advice from seasoned attorneys dedicated to the task of determining the costs and benefits of pursuing litigation either individually or as a Lead Plaintiff.

Attorney Johnson will take primary responsibility for monitoring investments, with both Attorneys Johnson and Perkinson evaluating potential legal claims and serving as Lead Counsel in any matter in which institutional investors are named as Lead Plaintiff and Johnson & Perkinson is selected as their counsel.

Johnson & Perkinson’s ability to monitor potential claims is on a par with any other firm. For example, Johnson & Perkinson subscribes to the Bloomberg Financial News Network, which carries all wire releases published on all of the major wire services. Bloomberg allows real-time searches by virtually any criteria, including, for instance, legal stories, lawsuits filed, or class actions, as well as by company or security. Upon receipt of an institution's holdings, Johnson & Perkinson will input those portfolios into their Bloomberg system, which will then flag or highlight any of the companies in which the institutional investor has invested which are in the news. Johnson & Perkinson will also use other subscription databases such as Westlaw and PACER as well as news sources of general public circulation such as the SEC’s EDGAR database and established financial news services.

Additionally, Johnson & Perkinson will monitor any unusual price movements of the securities held by an institutional investor. In this way, Johnson & Perkinson will be in a position to monitor, on an ongoing basis, potential legal claims, to investigate any potential legal claims and to ascertain if any lawsuits are filed which relate to any of institutions holdings. In doing so, Johnson & Perkinson will also rely on its Westlaw subscription, which provides access to historical news stories from virtually every major newspaper across the country and many from around the world. Additionally, upon receipt of the portfolios, Johnson & Perkinson will research whether any class actions have already been filed pertaining to any of the institution's holdings. Johnson & Perkinson’s monitoring services will be provided at no cost to institutional investors.
